Terms of Service

These Terms of Service ("Terms") govern your access to and use of InvoiceTrak (the "Service"). By creating an account or using the Service, you agree to these Terms.

Seller and contracting party

The Service is sold and provided by InvoiceTrak, operated by Isizwe Capital (Pty) Ltd, a registered legal entity trading as InvoiceTrak ("we", "us", "our", or the "Seller"). All references to "InvoiceTrak" in these Terms refer to Isizwe Capital (Pty) Ltd t/a InvoiceTrak, the legal contracting party for all subscriptions, deliveries, and services offered through this site.

1. Accounts and eligibility

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. Service description

InvoiceTrak is a proof-of-delivery platform that allows companies to upload invoices, assign drivers, capture signatures and photos, notify customers, and store delivery records in the cloud.

3. Subscriptions, payments and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you purchase a subscription you enter into a purchase agreement with Paddle, and Paddle is responsible for processing payments, invoicing, applicable sales tax/VAT, chargebacks, cancellations, and refunds. Payment, billing and cancellation mechanics are governed by Paddle's Buyer Terms.

• Plans are billed in South African Rand (ZAR) on a monthly basis unless otherwise stated.
• Applicable taxes are calculated and collected by Paddle at checkout.
• You may upgrade, downgrade, or cancel your subscription from your dashboard, or manage your subscription and invoices via Paddle at paddle.net.
• Upgrades take effect immediately and may be charged on a pro-rata basis.
• Downgrades and cancellations take effect at the end of the current paid billing period.
• Refunds are handled in line with our Refund Policy and Paddle's refund handling.

4. Acceptable use

You agree not to misuse the Service, including but not limited to: uploading unlawful content, attempting to access data you are not authorised to view, interfering with security features, or using the Service to harass others.

5. Data and content

You retain ownership of the invoices, customer data, and other content you upload. You grant us a limited licence to host, process, and transmit that content solely to provide the Service.

6. Intellectual property

All software, designs, logos, and materials provided by Isizwe Capital (Pty) Ltd remain our property. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

7. Limitation of liability

To the maximum extent permitted by law, Isizwe Capital (Pty) Ltd is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your account if you violate these Terms. Upon cancellation, your data will be retained in accordance with our Privacy Policy and applicable law.

9. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of South Africa.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
